A consensual divorce is the simplest, fastest, and most cost-effective way to dissolve a marriage in Greece. Under the current legal framework (Law 4509/2017), a consensual divorce no longer requires a court judgment but is completed by means of a notarial deed.
The procedure is initiated by the spouses' written agreement to dissolve their marriage. This agreement is executed in writing by the spouses in the presence of their respective legal counsel, as each spouse must be represented by a separate attorney. The agreement is signed by both spouses and their attorneys. Alternatively, it may be signed solely by the attorneys, provided that each attorney has been granted a special power of attorney by the respective spouse.
Where the spouses have minor children, their agreement must also include provisions concerning a) the exercise of legal guardianship and the custody of the children, b) the communication (visitation) rights of the parent who does not exercise custody and c) child maintenance. After the lapse of ten (10) days from the signing of the private agreement, the spouses and their attorneys submit the agreement before a Notary for the execution of the notarial deed dissolving the marriage, which is signed by the spouses and their respective attorneys.
Following the execution of the notarial deed, a certified copy is filed with the Civil Registry where the marriage was originally registered. The dissolution of the marriage becomes legally effective on the date the notarial deed is filed with the Civil Registry, and not on the date on which the notarial deed is executed.
