RECOGNITION OF A FOREIGN COURT JUDGMENT

The recognition of a foreign court judgment in Greece requires the filing of an application before the competent greek court, which is the Single-Member Court of First Instance within whose district the applicant has their domicile or residence.

 

Requirements for the Recognition of a Foreign Judgment in Greece

Subject to the provisions of applicable international conventions, a judgment of foreign civil court shall be recognized and constitutes res judicata effect in Greece provided that:

  • It constitutes a final and binding judgment (res judicata) under the law of the country where it was issued
  • The foreign court had jurisdiction over the case in accordance with the applicable rules of private international law 
  • The unsuccessful party was not deprived of the right to be heard, to defend themselves, or generally to participate in the proceedings, unless such deprivation was in accordance with a provision that also applies to nationals of the state whose court rendered the judgment
  • The judgment is not contrary to a judgment rendered by a Greek court in the same case and constitutes res judicata for the parties between whom the decision of the foreign court was rendered 
  • The judgment is not contrary to greek public morals or public policy

 

Required Documents to Be Submitted to the Court

  • The foreign court judgment, legally translated into greek and authenticated either by an Apostille under the Hague Convention (for countries that have acceded to the Hague Convention) or certified by the competent Greek consular authorities abroad or the Greek Ministry of Foreign Affairs as to the authenticity of the signature of the foreign official (for countries that have not acceded to the Hague Convention)
  • A certificate issued by the foreign court that issued the judgment, confirming that the decision is final and irrevocable or that it is no longer subject to appeal or other legal remedies or that the deadline for filing such remedies has expired, provided this is not stated in the judgment itself
  • Any additional documents or certificates required depending on the nature of the foreign judgment to be recognized
